ok, but deserting the military while in a country that we are at war with seems like a suicide mission to me, if he wanted to leave why should we risk loosing lives(which we did in search for him) searching for someone who deserted for his own reasons(we searched for years before he was returned)? then after loosing lives for a deserter we are willing to trade terrorists for him.
Battle yea he deserted for his own reasons but that doesn't mean we should take him back, and why not focus on the marine in Mexico before focusing on a deserter?

The marine in Mexico has full right to be locked up. He actually broke the law by carrying illegal weapons across the border. The US can't do much about that.
