^i dont think they can do that...its not a federal crime for kids to play it, nor is it illegal for retailers to sell M rated games to minors. Retailers choose to follow ESRB as a store policy because they get shit if they dont. And banning an account for being to young i believe is descrimination based on age unless allowing a child on is a federal crime.
They do force you to accept tge TAC which states that a user can be banned at any time for any reason but i believe in some states it is illegal for a company to force consent to a TAC or EULA on an electronic medium IF that EULA/TAC violates a law protecting consumer rights (such as descrimination) and therefor if taken to court said TAC is negated
